Christian Business Owners: No Rights in NM

Organized homosexuality has prevailed again, this time with the help of a court in New Mexico. It has told a Christian photographer that she trespassed state law when she refused to photograph two lesbians at their “commitment ceremony.”

Judge Timothy Garcia of the state’s court of appeals upheld a ruling by New Mexico’s Civil Rights Commission that fined the owners of Elane Photography nearly $7,000 for its refusal to accept business from the two women.

Garcia’s ruling essentially says that “gay rights” trump the religious rights of every employer and business in the state.

The trouble began for Elaine and John Huguenin, owners of Elane’s Photography, in 2008 when Vanessa Willock inquired about hiring Mrs. Huguenin to photograph her “commitment ceremony” to her lesbian partner. New Mexico does not allow homosexual marriage.

As the court described it, Huguenin was civil in her answer: “Elane Photography quickly responded, thanking Willock for her interest but explaining that Elane Photography photographs ‘traditional weddings,' ” the court wrote.

Unsure what Elane Photography meant by “traditional weddings,” Willock sent a second email asking Elane Photography to clarify whether it “does not offer [its] photography services to same-sex couples.”  Elane Photography responded affirmatively, stating, “[y]es, you are correct in saying we do not photograph same-sex weddings,” and again thanked Willock for her interest in Elane Photography.

Of course, Willock knew exactly what Mrs. Huguenin meant by “traditional weddings,” so the angry woman then, apparently, importuned her lesbian partner to set the photographer up for the discrimination claim.

            All are mental attitude sins that can lead to overt sins except murder but all sins including homosexuality can be forgiven and the person change through the Word of God.

            just read Paul's letter to the Galatians. he starts off fast getting to work on correcting the church for they teaching bad doctrine. you can not do a good job of teaching morals without having good sound doctrine.

            Generally, doctrinal sins are because people believe exactly what they want to believe. If it is a sin that they will not give up, they twist scriptures until it fits their sin, as OK. Problem with that, they cannot fool GOD and refuse to change to HIS ways

            The article is about the photographer being fined for not photographing lesbians kissing. The court-ordered punishment is the true crime, and would cause anyone with a conscience to become *homophobic*. You don't have to be a Christian to be alarmed about this ruling.

            The kindness comes in when you try to teach them how wrong their behavior is, and how much God disapproves of this sort of degeneracy. It is not the sort of behavior that the Bible condones.

            And as for respect, well…respect is like a paycheck, it has to be earned. What is there, about homosexuality, that is worthy of respect? A man wants to have sex with another man. That sort of perversion somehow earns him respect? "Hey, nice going! Hat's off to you!!"

            That is true, we should treat them with the respect that we would give to any fellow human being. But we cannot respect their immoral behavior any more than we could respect the behavior of a bank robber. To tell them that their behavior is fine and that they should just continue is ultimately an act of hatred.

            The homosexual lifestyle is very detrimental to the person's health and well-being, and homosexuals have a much shorter lifespan than heterosexuals. And even worse, if they continue their behavior until the end of their life, they will be eternally separated from God.

            If we really want to show love to a homosexual, we should not offer them any mealy-mouthed platitudes about how their lifestyle is acceptable, that we understand that they were 'born that way', that we are tired of discrimination, blah blah blah. Hogwash. We need to tell them the truth in love, and offer them the great hope of forgiveness and eternal life through Jesus Christ to release them from the bondage of their sin. The Gospel of Jesus Christ is the greatest act of love the world has ever seen.

            What people are you talking about? I do not know of a soul who is bothering them. Or are you talking of us disapproving of them committing this abomination to GOD? I am not pleased with myself when I break one of HIS commandments and I critize myself far more I do them. We tell them of the evil they are committing, so that they will know it is evil and will maybe, change. If we can cause one to change his/her life we will have let one to CHRIST. If we don't do anything, to show them they are committing this abomination, we cannot bring one to GOD.             Even though I question the motivation of Dave's, I realize that condemning the person is wrong but totally agree that condemning the evil the person(s) do is absolutely correct. Love the sinner but hate the sin. God condemns the sin and loves the sinner or none of us would go to Heaven – why Jesus was sent, died, and resurrected, He could open the door – no one goes to the Father (Old or New Testament, all creeds, all races, etc) except through the Son (Jesus). We are all sinners and can't go to the place of perfect love, joy, peace, and Holiness except through Him. You got to have an intimate relationship with God to grow to be like Him.

            Homosexuality is a great sin, so is intentional lying, stealing, slandering others, hate, etc… God created Adam and Eve not Adam and Steve. In order to justify these actions (wrong actions are always tried to be justified by individuals or groups so that they can cover guilt.) people are trying to find homosexuality in animals. If God says that it is wrong and unnatural you won't be able to justify yourself when you stand before Him, only Jesus can eliminate forgive sin and set people free. We are all flawed, just try to justify our actions by looking for others with flaws we can call worse. God loves the sinner but hates the sin, because sin is what separates us from Him.

            It is to a person's discredit to hate anyone but also to call evil good.and good evil. Read the Bible and let God's Holy Spirit instruct you then we will all be on the same page. Otherwise, without God's guidance – instruction from the Author of the Book, you are reading words and twisting them to mean what you want. It is what it is; He is Who He is!!!!

            What do you think Gods purpose for hermaphrodites is? To be with a woman or to be with a man?

            And I cannot think what you may think my motivations are. I simply don't like that so many Americans are focused on not allowing homosexuals to marry. God will not be any more upset than he is about tattoo's being legal.

            hermaphrodite is a birth defect like being born without limbs or any other body parts. it is caused by a hormonal problem during development they still have a biological gender. it can be determined by watching the chromosomes during cell division.

            You may try to make that point, but it's illogical. We do not derive our morality from animals. Many animals kill each other also. Does that mean we should? Also, the so-called 'homosexuality' in nature is highly subjective, being subject to the biases of the observer. If two male bears hug each other, for instance, is this 'homosexual' behavior?

            An observer with a homosexual bias who is trying to justify it would probably conclude that it was. But maybe the bears were just trying to keep warm. Since we have no way of knowing what is going through the mind of an animal when they engage in certain behaviors, we do not know their motives for doing so. It would merely be the interpretation of the observer that the behavior was or was not 'homosexual'.

            As for hermaphrodites, as with anyone, who is forcing them to engage in sexual relations? If they are not sure what sex they are, they should simply abstain from any sexual behavior. While sexual activity may be enjoyable, it is certainly not an essential activity for maintaining life. I haven't heard of anyone dying from a lack of sex (other than on late-night comedy shows).

            From reading many of your posts, Dave it is hard to believe that you have so little understanding of GOD'S WORKS, to think for a moment that HE would make a homosexual. He makes each of "just so" and gives us the privilege to live for HIM or against HIM, this choice given to us by HIM. If HE did not give us this choice we would be no more that puppets. We will be given the home for which we work,in the end, not what we earn because we cannot earn heaven, it will be given to those who strive to live according to the commandments that HE gives us to live by.

            Few shall be called but few are chosen, because we want heaven handed to us without any effort, it won't happen.

        There must be a website somewhere for liberals and atheists to find several verses from the Old Testament to use as a reason for disregarding the entire Bible because you all always cite to the same few verses. If any of you took the time to study the Bible in depth, you would find that there were some rules that God gave to the Israelites to separate them from the other cultures around them because he was preparing them for the Messiah to come through their people. Those rules are separate and distinct from the moral laws that He set out in the Ten Commandments, etc.

        Furthermore, living in Santa Fe where there is a large population of homosexuals, I can tell you that most Christians I know treat them with much more respect than they treat the Christians. Does that make you sad, too?

          Yes, I am surprised he did not use the "shellfish" argument, which has been refuted:

      Free will is precious to God and to us. It is the greatest form of freedom. It really upsets me when people 'do as they will' and then if things go wrong blame God when He is a perfect gentleman and lets us make our own choices — our choices bring reward or consequences. It is also strange to me when people ask for God's help and they get it then they take credit for the victory and forget about God. On the flip side, they don't get God's help (because He knows it is not good for them or has no intimacy with that person) then they blame God.
      I suppose blaming others for wrongs or conceitedly crediting self for goo things is hitting at the 'heart' of the matter and why God says, "the heart is deceitfully wicked." That is why He is the biggest and best heart surgeon, straightening out issues of the heart.

    What ever happened to the right of a business to refuse service to anyone??? Next, the courts will be dictating who we can socialize with, who we must invite to our homes for dinner, who we can have for friends, who we can marry (if we can marry) and possibly the gender or our "chosen" life mate. Since when does the word "liberal" translate to restricting??? If they are as "liberal" as they claim, we should be able to do what ever we want, and with whom we want…….which is obviously NOT the case any more, at least in New Mexico.

      Regarding who we can socialize with…well, there have been cases where individuals have been labeled as racists, even though they may have (and did have) several close friends who were of different races. It all about what is "perceived" rather than what is. Look at the Duke lacrosse team farce.

      Or the fact that my spouse and I have been repeatedly called "homophobes" despite the fact that we had two "gay" individuals in our wedding party. The point was not that they were gay, the point was who they were to us. And when requested to identify the "gay" individuals in a photo of our wedding party, no one has managed it yet. Personally, we don't care, but the fact remains that if we were in fact, homophobes, those two individuals would not have been invited to our wedding, much less take part.

I guess you also don't realize that we have many mountain ranges here and several different climates? It's not all a desert, although I'm not exactly sure what kind of an indictment that is. Do you feel the same way about Arizona since it has a lot of desert area, too? Very strange comment.

      What a stupid statement to make about NM. I have some great friends who live there who are conservative Bible Doctrine believers who love the Word of God along with their church group. There are parts of NM that are absolutely breathtaking. There are many great tourist attractions. Yes, there are many things wrong in NM but one will find that in every State of the Union. The American Indians were not allowed to be overbearing in this Nation because of their anti-Biblical beliefs that God did not want spread in a country that was set aside as a Client Nation in the Church Age to uphold His truths.

      So you have no problem with courts telling private business owners with whom they can and cannot conduct business? Would you also be in favor of the judge forcing a lesbian photographer to photograph a heterosexual wedding if she decided it was against her beliefs?

      Although you should be more outraged by the tyranny of a civil judge telling a private business owner how to conduct business than over the reasons for the owner's declining of the job, it is apparent that your upside-down ideology of "freedom" dictates that you be far more concerned about forcing your "tolerance" on others than on governmental invasion of individual rights.

The state of NM is walking on eggs here and this should go to a higher court and be clarified…It's not like there were no other photographers available and the pictures could not have been taken by someone else.

    Exactly– if they have a problem with Elane Photography, then they, their friends and acquaintances should take their business elsewhere. Let the marketplace decide whether they deserve to stay in business.

    On a practical note — would anyone REALLY want to hire a photographer who doesn't want to be there? You can make them work, but you can't make them do the job well.

Help the elderly or handicapped get information, or ballots, or into the voting booth. If you can't vote, write letters to elected officials.     I'm sorry for the photography couple who have been chosen by the "gay agenda" forces to be made an example of and to be used to establish legal precedent , if possible. This couple needs support and will be assisted through the appellate process all the way up to the SCOTUS if necessary., because they cannot be allowed to succeed. A real danger lies in the idea of so many of these engineered offenses happening that the fighters for righteousness are overwhelmed. Still, that in itself would move the whole thing toward the high court. After this November's elections, the radical left will find it's microphone turned way down!

      I live in New Mexico (and unfortunately I work for the court that issued this opinion), and I have read that this poor couple lost their business because of all the legal fees, etc., associated with this. If I hear of a way to help them with their appeal, I will try to find a way to let people on this site know. Interestingly, this judge who wrote this opinion is up for retention in November . . .

    If this was a free market, the products and services would take care of themselves, as there is demand for such services.
    To think that just a business provides a product or service means they MUST serve, is crazy. Only AFTER both parties have entered into a contract are they bound to honor their word.

    Initially, homosexual lobbyist groups said, "All we want is to be left alone." Then, a few years later, they said, "We just want our lifestyle to be accepted."

    Not long after that it was, "We want our lifestyle to be legally recognized as a civil union." And finally it went all the way to, "We want nothing less than marriage," which, since creation, has been defined and accepted as a sacred institution between a man and a woman.

    Now, in England at least, they are demanding that churches be "compelled" to do that which is contrary to their deeply held convictions. And now it has extended to private business owners.

    They are even demanding that we teach children to uphold homosexuality as a virtue. We are watching the breathtaking success of homosexual lobbyists as they intimidate lawmakers into passing so-called 'hate crimes' legislation that has destroyed the freedoms of Christians.

    I worked in SF for years and know first hand how the homosexual community works to cheat their employer and if you say anything against their lifestyle they will turn you in. When I let an office mate know that I did not want to hear about his love life he was offended and turn me in to HR. When I asked HR what they would have done if I complained first they said they did not know what they would do. The head of HR for this company was a lesbian and I was fortunate that the HR person handling my case was a Christian. Within a few weeks the offices were moved to a new building and we were on opposite sides of that building. Even though I had to associate with him through work assignments I was always polite to him. He moved back to Hawaii a short time later. It is amazing how God works things out when we turn the matter over to Him.

    A scientist once explained to me that one way to test an hypothesis is to examine its limits. If we test homosexuality, we can assume the limits would be 1. Nobody is homosexual and 2. Everybody is homosexual. If nobody were homosexual, there would be no impact on the continuation of humanity. If everybody were homosexual, the human race would become extinct.

    The environmental wackos will be pushing for homosexuality so the earth won't have anyone to disturb the little birds and bees.

    Torn Between One Way and Another
    1-3 You shouldn't have any trouble understanding this, friends, for you know all the ins and outs of the law—how it works and how its power touches only the living. For instance, a wife is legally tied to her husband while he lives, but if he dies, she's free. If she lives with another man while her husband is living, she's obviously an adulteress. But if he dies, she is quite free to marry another man in good conscience, with no one's disapproval.

    4-6So, my friends, this is something like what has taken place with you. When Christ died he took that entire rule-dominated way of life down with him and left it in the tomb, leaving you free to "marry" a resurrection life and bear "offspring" of faith for God. For as long as we lived that old way of life, doing whatever we felt we could get away with, sin was calling most of the shots as the old law code hemmed us in. And this made us all the more rebellious. In the end, all we had to show for it was miscarriages and stillbirths. But now that we're no longer shackled to that domineering mate of sin, and out from under all those oppressive regulations and fine print, we're free to live a new life in the freedom of God.

    7But I can hear you say, "If the law code was as bad as all that, it's no better than sin itself." That's certainly not true. The law code had a perfectly legitimate function. Without its clear guidelines for right and wrong, moral behavior would be mostly guesswork. Apart from the succinct, surgical command, "You shall not covet," I could have dressed covetousness up to look like a virtue and ruined my life with it.

    8-12Don't you remember how it was? I do, perfectly well. The law code started out as an excellent piece of work. What happened, though, was that sin found a way to pervert the command into a temptation, making a piece of "forbidden fruit" out of it. The law code, instead of being used to guide me, was used to seduce me. Without all the paraphernalia of the law code, sin looked pretty dull and lifeless, and I went along without paying much attention to it. But once sin got its hands on the law code and decked itself out in all that finery, I was fooled, and fell for it. The very command that was supposed to guide me into life was cleverly used to trip me up, throwing me headlong. So sin was plenty alive, and I was stone dead. But the law code itself is God's good and common sense, each command sane and holy counsel.

    13I can already hear your next question: "Does that mean I can't even trust what is good [that is, the law]? Is good just as dangerous as evil?" No again! Sin simply did what sin is so famous for doing: using the good as a cover to tempt me to do what would finally destroy me. By hiding within God's good commandment, sin did far more mischief than it could ever have accomplished on its own.

    14-16I can anticipate the response that is coming: "I know that all God's commands are spiritual, but I'm not. Isn't this also your experience?" Yes. I'm full of myself—after all, I've spent a long time in sin's prison. What I don't understand about myself is that I decide one way, but then I act another, doing things I absolutely despise. So if I can't be trusted to figure out what is best for myself and then do it, it becomes obvious that God's command is necessary.

    17-20But I need something more! For if I know the law but still can't keep it, and if the power of sin within me keeps sabotaging my best intentions, I obviously need help! I realize that I don't have what it takes. I can will it, but I can't do it. I decide to do good, but I don't really do it; I decide not to do bad, but then I do it anyway. My decisions, such as they are, don't result in actions. Something has gone wrong deep within me and gets the better of me every time.

    21-23It happens so regularly that it's predictable. The moment I decide to do good, sin is there to trip me up. I truly delight in God's commands, but it's pretty obvious that not all of me joins in that delight. Parts of me covertly rebel, and just when I least expect it, they take charge.

    24I've tried everything and nothing helps. I'm at the end of my rope. Is there no one who can do anything for me? Isn't that the real question?

    25The answer, thank God, is that Jesus Christ can and does. He acted to set things right in this life of contradictions where I want to serve God with all my heart and mind, but am pulled by the influence of sin to do something totally different.

    The Solution Is Life on God's Terms
    1-2With the arrival of Jesus, the Messiah, that fateful dilemma is resolved. Those who enter into Christ's being-here-for-us no longer have to live under a continuous, low-lying black cloud. A new power is in operation. The Spirit of life in Christ, like a strong wind, has magnificently cleared the air, freeing you from a fated lifetime of brutal tyranny at the hands of sin and death.

    3-4God went for the jugular when he sent his own Son. He didn't deal with the problem as something remote and unimportant. In his Son, Jesus, he personally took on the human condition, entered the disordered mess of struggling humanity in order to set it right once and for all. The law code, weakened as it always was by fractured human nature, could never have done that.

    The law always ended up being used as a Band-Aid on sin instead of a deep healing of it. And now what the law code asked for but we couldn't deliver is accomplished as we, instead of redoubling our own efforts, simply embrace what the Spirit is doing in us.

    5-8Those who think they can do it on their own end up obsessed with measuring their own moral muscle but never get around to exercising it in real life. Those who trust God's action in them find that God's Spirit is in them—living and breathing God! Obsession with self in these matters is a dead end; attention to God leads us out into the open, into a spacious, free life. Focusing on the self is the opposite of focusing on God. Anyone completely absorbed in self ignores God, ends up thinking more about self than God. That person ignores who God is and what he is doing. And God isn't pleased at being ignored.

    9-11But if God himself has taken up residence in your life, you can hardly be thinking more of yourself than of him. Anyone, of course, who has not welcomed this invisible but clearly present God, the Spirit of Christ, won't know what we're talking about. But for you who welcome him, in whom he dwells—even though you still experience all the limitations of sin—you yourself experience life on God's terms. It stands to reason, doesn't it, that if the alive-and-present God who raised Jesus from the dead moves into your life, he'll do the same thing in you that he did in Jesus, bringing you alive to himself? When God lives and breathes in you (and he does, as surely as he did in Jesus), you are delivered from that dead life. With his Spirit living in you, your body will be as alive as Christ's!

    12-14So don't you see that we don't owe this old do-it-yourself life one red cent. There's nothing in it for us, nothing at all. The best thing to do is give it a decent burial and get on with your new life. God's Spirit beckons. There are things to do and places to go!

    We have the freedom in Christ to refuse to have anything to do with something that displeases God. Our laws give Muslims have the right to refuse anything to do with worldly living and that against their religion. In our country we still have freedom of "religion." No one can make us do anything against what we know is wrong by our "religion's" standards. This "couple" is discriminating against the photographer for her Christian beliefs. She has the right to a countersuit. Now let's call his "Lesbian" or homeosexual business what it is and see how it fits. The real name for it is "Sodomy" and it is against God's law and man's law, therefore we have the right to refuse to participate as a Christian or an American. Overcomers, don't be so afraid. There are worse things coming. Stand for the ri'ght thing. Don't waver. Man can't hurt you. Fear (revere) God who has the power over your soul.

    Actually the first ammendment covers the problem in NM since Constitutional law ssays that if a law does not go with the constitution then the law must be thrown out and the one gives special rights to some unclean/immoral people
